By accessing or using MediLink's platform, mobile applications, and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

MediLink provides a secure platform for electronic health records management, connecting patients with healthcare providers across Ghana. Our Services include:

• Secure storage and management of electronic health records
• Patient identity verification and QR-based identification
• Consent management for health data sharing
• Healthcare provider portals for clinical workflows
• Mobile applications for patients and providers

User Accounts

Registration

To use our Services, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials.

Account Security

You are responsible for all activities that occur under your account. Notify us immediately if you suspect unauthorized access to your account. We recommend enabling all available security features, including biometric authentication.

Account Types

MediLink offers different account types for patients, healthcare providers, and healthcare institutions. Each account type has specific features, permissions, and responsibilities.

Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose
• Access health records without proper authorization
• Attempt to circumvent security measures
• Share your account credentials with others
• Upload malicious content or code
• Interfere with the proper functioning of the Services
• Collect or harvest data from other users
• Impersonate another person or entity

Healthcare Provider Terms

Healthcare providers and institutions using MediLink agree to additional terms:

• Maintain valid professional licenses and accreditation
• Access patient records only for legitimate healthcare purposes
• Comply with all applicable healthcare regulations and standards
• Train staff on proper use of the platform and data protection
• Report any security incidents or data breaches immediately
• Maintain accurate and complete medical records

Health Information

Accuracy

While we strive to ensure the accuracy of health records on our platform, MediLink is not responsible for errors in information entered by healthcare providers. Users should verify critical health information with their healthcare providers.

Not Medical Advice

MediLink is a health records platform, not a healthcare provider. The information displayed in our Services is for informational purposes only and does not constitute medical advice, diagnosis, or treatment. Always consult qualified healthcare professionals for medical decisions.

Fees and Payment

Patient Accounts

MediLink is free for individual patients. We do not charge patients for accessing their health records or using basic platform features.

Healthcare Provider Accounts

Healthcare institutions pay subscription fees based on their size and usage. Fees are specified in separate service agreements. We reserve the right to modify pricing with 30 days' notice.

Intellectual Property

All content, features, and functionality of MediLink, including software, text, graphics, logos, and icons, are owned by MediLink and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

Third-Party Services

Our Services may integrate with third-party services. These integrations are subject to the terms and privacy policies of those third parties. MediLink is not responsible for third-party services.

Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

MEDILINK IS NOT A HEALTHCARE PROVIDER AND DOES NOT PROVIDE MEDICAL ADVICE. WE ARE NOT RESPONSIBLE FOR HEALTHCARE DECISIONS MADE BASED ON INFORMATION IN OUR PLATFORM.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEDILINK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICES.

Indemnification

You agree to indemnify and hold harmless MediLink, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services or violation of these Terms.

Termination

We may suspend or terminate your account if you violate these Terms or for any other reason at our discretion. Upon termination, your right to use the Services will immediately cease. Provisions that by their nature should survive termination will survive.

Governing Law

These Terms are governed by the laws of the Republic of Ghana. Any disputes arising from these Terms or your use of the Services shall be resolved in the courts of Ghana.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. Continued use of the Services after changes constitutes acceptance of the new Terms.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
